Terms of service

General provisions

These Terms of Service set out the rules for using By Matthew, the conditions for providing services electronically, and the rules for concluding product sales contracts through the store.

The seller operating By Matthew is:

hereinafter referred to as the “Seller”.

The Seller can be contacted by email at customerservice@bymatthew.cc.

The Seller makes these Terms of Service available to Customers free of charge through the store’s website.

By placing an order and using the store, the Customer accepts the provisions of these Terms of Service.

Whenever the following terms are used in these Terms of Service, they shall have the following meanings:

  • Email address – a designation of an information and communications technology system enabling communication by electronic means, particularly electronic mail.

  • Cookies – text files stored by the website on the user’s device that enable the website to function properly and allow the way in which the store is used to be analysed.

  • Customer – a natural person, legal person, or organisational entity purchasing products through the online store.

  • Means of electronic communication – technical solutions enabling individual communication at a distance, particularly electronic mail and the online store.

  • Online store – the website operated by the Seller at bymatthew.cc, through which the Customer can view the offer, place orders, and use the available services.

  • Sales system – the online store functionalities that enable orders to be placed and sales contracts to be concluded.

  • Services provided electronically – services performed by sending and receiving data through information and communications technology systems at the Customer’s individual request.

Scope of activity

The Seller provides the following services electronically:

  • the sale of products offered through the online store, particularly cases for mobile devices and other products included in the current offer;

  • enabling Customers to view the current offer, product information, and applicable promotions.

To provide the services described above, the Seller uses means of electronic communication, particularly the online store and electronic mail.

The costs incurred by the Customer when using means of electronic communication are no higher than the standard costs of using such services under the tariff of the operator whose services the Customer uses.

Technical requirements and information

The following are required to use the online store:

  • an electronic device with internet access;

  • an up-to-date web browser that supports cookies and JavaScript;

  • an active email account.

An active email address capable of receiving order-related information is additionally required to place orders.

Information contained in system logs, such as the user’s IP address, is used by the Seller exclusively for technical, security, and statistical purposes.

The online store uses cookies to ensure that the website functions properly, improve the quality of services, and adapt content to users’ preferences. Disabling cookies in the browser may limit access to certain store functionalities.

Placing orders

Orders for products available in the store are placed through the sales system.

The Customer may use the online store if they have the legal capacity required under applicable law.

To place an order, the Customer must:

  • select a product and its variant;

  • provide the required information necessary to fulfil the order, particularly contact and delivery details;

  • verify that the information provided is correct;

  • accept these Terms of Service.

An order is placed by clicking the button that completes the purchase, labelled, for example, “Pay now”.

The Customer’s placement of an order constitutes an offer to conclude a sales contract within the meaning of civil law.

After placing the order, the Customer receives an automatic confirmation at the email address associated with the order.

The Customer represents that:

  • they have read and accept these Terms of Service;

  • the information provided is complete and accurate;

  • they are authorised to conclude the sales contract;

  • the information provided does not infringe the rights of any third party.

Delivery and order fulfillment

Products available from By Matthew are prepared after an order is placed. Order processing times may vary depending on the type of product and the current production workload.

Information concerning estimated processing and delivery times is presented when the order is placed.

Deliveries are carried out by selected courier companies and logistics operators available for the relevant destination country.

The Seller fulfils orders in the countries available during the order placement process.

The delivery time depends on the selected delivery method and the delivery address provided by the Customer.

The Seller shall not be liable for delays resulting from circumstances beyond the Seller’s control, particularly:

  • carrier delays;

  • unforeseen events;

  • actions taken by customs authorities;

  • incorrect information provided by the Customer.

The Seller reserves the right to refuse to fulfil an order if:

  • the order cannot be fulfilled for technical or logistical reasons;

  • the information provided by the Customer cannot be verified;

  • the Customer breaches these Terms of Service;

  • there are reasonable concerns regarding the order.

If the Seller refuses to fulfil an order, the Customer will be notified at the email address associated with the order.

Product returns

Products purchased from the By Matthew may be returned in an undamaged condition within 14 days of receiving the order.

Before sending a return, the Customer should contact us to receive the correct return address and further instructions. The return address may vary depending on where the order was fulfilled.

The Customer should print the order confirmation email, clearly mark the products being returned, and include the printed confirmation inside the return parcel.

All returns are inspected after they are received at the designated return facility. We only accept returns of products purchased directly from bymatthew.cc.

If you return products in a manner that does not comply with this Returns policy, By Matthew reserves the right to refuse the return or reduce the refund amount accordingly, in accordance with applicable law.

For orders that included a free promotional product, the promotional product must also be returned.

Returns are usually processed within three business days after the parcel is delivered to the designated return facility. Once the process has been completed, you will receive a confirmation email containing details of the refund amount.

The refund will be issued using the same payment method used when placing the order unless you expressly agree to another solution.

Depending on your payment provider or bank, it may take 7–10 business days for the refund to be credited.

By Matthew reserves the right to monitor return activity and refuse returns in cases of abuse or activity that does not comply with this Online Return Policy.

Right of Withdrawal

You have the right to withdraw from the contract within 14 days of receiving your order, in accordance with applicable law.

To exercise your right of withdrawal, go to the Shipping and Returns and select the “Contract withdrawal” button at the bottom of the page.

After completing and submitting the form, you will receive the correct return address and further instructions. The return address may vary depending on where your order was fulfilled.

Return the product at your own expense to the address provided to you by By Matthew.

You do not need to wait for your return to be approved. Contacting us before sending the parcel is required only to ensure that it is sent to the correct return facility.

The parcel must include a printed copy of your order confirmation email with the returned products clearly marked. This will allow us to identify the return efficiently and process it more quickly.

If you no longer have access to your order confirmation email or are unable to print it, please contact us before sending the parcel. We will provide the information required to identify your return correctly.

The product must be returned in a condition that allows its nature, characteristics, and functioning to be assessed in accordance with applicable law.

Once the parcel has been received and inspected, we will refund the amount due in accordance with applicable law.

The refund will be issued using the same payment method used for the purchase unless you expressly agree to another solution.

Complaints

The Seller undertakes to provide products that comply with the concluded contract and are free from physical and legal defects.

If the product received is damaged, defective, or does not correspond to the order, the Customer should contact the Seller.

A complaint may be submitted by contacting us.

To enable the complaint to be handled efficiently, the submission should include:

  • the order number;

  • a description of the problem;

  • photographs showing the product’s defect or non-conformity.

The Seller handles complaints within the period prescribed by applicable law.

If a complaint is found to be justified, the Seller will take appropriate action, which may include repairing or replacing the product, reducing the price, or issuing a refund in accordance with applicable law.

Product prices

The product prices displayed in the online store are gross prices and include the VAT applicable when the order is placed.

The product price displayed when the order is placed is the total price the Customer is required to pay, excluding any additional delivery costs associated with the delivery method selected by the Customer, where applicable.

Before placing an order, the Customer will be informed of:

  • the product price;

  • delivery costs;

  • available payment methods;

  • all additional costs related to fulfilling the order, where applicable.

By placing an order, the Customer accepts the price applicable at the time the order is placed.

Product prices may change; however, a price change will not affect orders placed before the change takes effect.

For orders fulfilled outside the European Union, the Customer may be required to pay additional charges arising under the laws of the destination country, particularly customs duties, import taxes, or other administrative charges.

The Seller shall not be liable for additional charges imposed by customs authorities or other institutions competent for the destination country.

Available payment methods

The available payment methods are presented to the Customer when the order is placed.

The online store may enable payments through electronic payment providers, including:

  • payment cards;

  • electronic wallets;

  • other methods available during the purchase process.

Payments are processed in accordance with the rules and terms of the relevant payment providers.

The Customer may only make a payment using a payment instrument they are authorised to use.

If an unauthorised transaction is suspected, the Seller reserves the right to take appropriate action, including contacting the Customer or refusing to fulfil the order.

If an order cannot be fulfilled after payment has been made, the Seller will return all funds received from the Customer using the same payment method used for the purchase unless the Customer agrees to another solution.

Gift cards

By Matthew may offer digital gift cards (“Gift Cards”) in denominations made available at the time of purchase. Each Gift Card has a monetary value and is issued with a unique redemption code.

After a Gift Card order has been fulfilled, the Gift Card and its unique redemption code are delivered electronically to the purchaser or, where the recipient option is used, to the designated recipient.

Gift Cards may be used as a payment method for eligible purchases from By Matthew through sales channels that support Gift Card redemption. The Gift Card code must be entered at checkout or otherwise presented using an available redemption method.

The available balance of a Gift Card is applied towards the total value of the order and may also be used towards applicable taxes and delivery charges.

A Gift Card does not need to be used in a single transaction. If only part of the available balance is used, the remaining balance remains available for future eligible purchases until it is fully used or the Gift Card expires.

If the available Gift Card balance is lower than the total amount due for an order, the remaining amount must be paid using another payment method accepted by By Matthew. More than one Gift Card may be used towards a single order where this functionality is available.

Gift Cards may be used together with eligible discounts and promotional codes, subject to the conditions applicable to the relevant discount or promotion.

Gift Cards cannot be used to purchase another Gift Card and cannot be exchanged or redeemed for cash, except where otherwise required by applicable law.

By Matthew Gift Cards are issued with a validity period of 12 months from the date of issue. After the validity period has expired, the Gift Card can no longer be redeemed automatically. The holder may contact By Matthew regarding any remaining unused balance and any reactivation or other rights available under applicable law.

The purchaser and recipient are responsible for keeping the Gift Card code secure. Anyone with access to a valid Gift Card code may be able to use the available balance. If a Gift Card email or code is lost, the purchaser or recipient should contact By Matthew. Where possible and after appropriate verification, By Matthew may resend the Gift Card information to the customer or recipient associated with the Gift Card.

If a refund is issued for an order that was paid for, in whole or in part, using a Gift Card, the relevant refund amount may be returned to the Gift Card in accordance with the applicable refund procedure. The available Gift Card balance will be updated accordingly.

If the purchase of a Gift Card itself is refunded where permitted or required under applicable law, the relevant Gift Card may be deactivated and may no longer be used.

The current Gift Card balance may be viewed using the Gift Card page or other functionality made available by By Matthew.

Gift Cards are subject to these Terms of Service and any mandatory rights granted to consumers under applicable law.

Liability

The Seller makes every effort to ensure that the information presented in the online store is current, complete, and accurate.

The Seller shall not be liable for:

  • interruptions in the operation of the online store caused by circumstances beyond the Seller’s control;

  • damage resulting from the use of the online store in a manner inconsistent with these Terms of Service or applicable law;

  • technical issues resulting from the operation of devices, software, or third-party services used by the Customer;

  • incorrect or incomplete information provided by the Customer when placing an order;

  • delays resulting from the actions of carriers, logistics operators, or other third parties.

The Customer is required to use the online store in accordance with applicable law, principles of social coexistence, and these Terms of Service.

The following are prohibited:

  • copying, distributing, or using materials available in the online store without the Seller’s permission;

  • taking any action that may interfere with the operation of the online store;

  • using the online store in a manner that infringes the rights of the Seller or any third party.

Copyright

All materials available in the online store, particularly:

  • product photographs;

  • graphics;

  • logos;

  • descriptions;

  • visual identity elements;

are owned by the Seller or are used under the appropriate rights and licences.

Copying, modifying, distributing, or using materials available in the online store without the Seller’s prior consent is prohibited unless otherwise permitted by applicable law.

SMS newsletter

The Seller may offer an optional SMS newsletter service to users who voluntarily provide their telephone number and give prior consent to receive marketing communications by SMS.

By subscribing to the SMS newsletter, the user agrees to receive commercial and marketing communications from By Matthew at the telephone number provided, including information about products, collections, promotions, offers, and other news relating to By Matthew.

Consent to receive SMS marketing communications is voluntary and is not required to place an order or otherwise use the online store.

The user may withdraw their consent and unsubscribe from the SMS newsletter at any time using the unsubscribe method indicated in the SMS message or by contacting the Seller.

The frequency of SMS messages may vary. Any charges imposed by the user's mobile operator are governed by the user's agreement with that operator.

Final provisions

These Terms of Service enter into force on 18 August 2026.

The Seller reserves the right to amend these Terms of Service in the event of:

  • changes in applicable law;

  • changes to the operation of the online store;

  • the introduction of new services or functionalities.

Amendments to these Terms of Service shall not affect orders placed before the amendments enter into force.

If any provision of these Terms of Service is found to be invalid or ineffective, the remaining provisions shall remain in force.

Sales contracts are concluded in Polish.

Contracts concluded through the online store are governed by Polish law, subject to any mandatory provisions of law applicable to consumers.

In matters not governed by these Terms of Service, the relevant provisions of law shall apply, particularly:

  • the Polish Civil Code;

  • the Polish Consumer Rights Act;

  • the Polish Act on Providing Services by Electronic Means;

  • other applicable laws.

In the event of a dispute, the Customer may use out-of-court consumer dispute resolution methods, including mediation or other available procedures, in accordance with applicable law.
